In today's hyper-connected world, telecommunications are as essential as utilities like water and electricity. Yet, while technological advancements have redefined how we work, learn, and communicate, the policies regulating these innovations remain stuck in the past. One glaring example is the misapplication of the National Environmental Policy Act (NEPA)-a 50-year-old law intended to safeguard the environment from large-scale federal projects-now being wielded inappropriately to regulate modern telecommunications technologies. This outdated approach is not only inefficient but also exploitative, as it unjustly inflates consumer expenses each month.

NEPA, enacted in 1970, was designed to assess the environmental impact of significant federal projects like highways, dams, and power plants. However, its use for low-impact telecommunications projects, such as small cell antennas or 5G infrastructure, is a clear mismatch for the needs of today. Consulting firms and industry stakeholders have exploited the law's vague language, stretching its scope to require exhaustive environmental reviews for projects that pose minimal, if any, environmental risk. These unnecessary reviews generate significant profits for a select few while creating delays and inflating costs, with the burden ultimately falling on consumers in the form of higher phone bills.

This misapplication of NEPA stifles progress in deploying critical technologies, forcing American families and businesses to bear the financial burden of inefficiencies they cannot control. Every month, higher connectivity costs are driven not by technological limitations but by a bloated regulatory system designed to protect profits for consulting firms and vested interests. The irony is glaring: a law meant to safeguard the environment is being used as a tool for profiteering while delaying infrastructure improvements that could benefit society at large.

Regulating modern technologies with a policy designed for the 20th century is not just outdated-it's irresponsible. It wastes resources, slows progress, and makes life more expensive for millions of Americans. Regulatory agencies have a duty to adapt to the times, balancing environmental stewardship with the practical realities of modern technology. Continuing to enforce these archaic policies in a fast-evolving digital era is not only inefficient but profoundly unfair to the consumers who bear the cost of this misalignment.

This book calls for a reevaluation of how NEPA is applied to telecommunications. It's not about weakening environmental protections; it's about recalibrating them for today's needs. Policymakers must act to streamline regulations, eliminate redundancies, and ensure that progress comes without unnecessary costs to consumers. By modernizing our regulatory approach, we can achieve a system that supports innovation, reduces costs, and preserves environmental integrity-a win for everyone except those profiting from inefficiency.
