To this end, the ineffectiveness of this principle is observed in the system of accommodation of prisoners within the penitentiary institutions in the DRC in general and in particular within the central prison of Bukavu. It should be noted that the failure to observe the principle of separation of detainees in the central prison of Bukavu is due to overcrowding resulting from the inadequacy of prison facilities, but also from the excessive use of successive pre-trial detention, the absence of a military prison in South Kivu and the lack of state support for the Congolese prison system.
